BacStage App – Fan / Follower In-App Agreements

1. Terms of Service (Followers)

1.1 Platform Role

BacStage is a technology marketplace that facilitates paid, real-time video interactions between users (“Followers”) and independent third-party creators (“Talent”). BacStage is not the provider of the video calls and does not control or guarantee Talent performance, conduct, or outcomes.

1.2 Eligibility

You must be at least eighteen (18) years old to use the BacStage App. By creating an account, you represent and warrant that you meet this requirement.

1.3 Booking/Scheduling & Pricing

• Talent independently sets pricing, duration, and availability for video calls
• Pricing may be per-minute or fixed time slots
• BacStage may charge a platform service fee, which may be included in or added to the displayed price

1.4 Payments

• All payments are processed through Stripe
• BacStage may temporarily hold funds through Stripe Connect until a call is completed
• By booking/scheduling a call, you authorize BacStage and Stripe to charge your selected payment method

1.5 Chargebacks, Refunds, Missed Calls & Rescheduling

If Talent fails to attend a scheduled call, Follower may request a reschedule or refund.

Refunds may be issued by agreement of both parties or at BacStage’s discretion.

No refunds will be issued for missed calls caused by the Follower.

Chargebacks: If you initiate a chargeback via your payment provider, BacStage reserves the right to temporarily suspend your account pending resolution. Chargebacks deemed fraudulent or unwarranted may result in account termination. Refund decisions made by BacStage remain final, regardless of chargeback status.

1.6 Prohibited Conduct

You agree not to:

• Engage in harassment, hate speech, threats, or discriminatory conduct
• Request or engage in illegal, sexual, or exploitative activity
• Attempt to move payments or interactions off-platform
• Record or distribute calls without required consent

Violations may result in immediate suspension or permanent termination.

1.7 Content & Recording

Video calls are live interactions. Recording is prohibited unless explicitly authorized. You waive any expectation of privacy during platform-facilitated calls.

1.8 Disclaimers & Limitation of Liability

BacStage provides the platform on an “as-is” basis and disclaims all warranties. BacStage is not liable for indirect, incidental, or consequential damages arising from Talent interactions.

1.9 Dispute Resolution

All disputes shall be resolved through binding arbitration on an individual basis. Class actions are waived.

2. Privacy Policy (Followers)

2.1 Information Collected

• Account information
• Payment data (processed by Stripe)
• Usage and device data

2.2 Use of Information

Information is used to operate the platform, process payments, prevent fraud, and improve services.

2.3 Data Sharing

Data may be shared with Stripe and service providers as required to operate the platform. BacStage does not sell personal data.

2.4 User Rights

Users may request access, correction, or deletion of personal data subject to legal requirements.

3. Acceptable Use & Community Standards

BacStage enforces strict standards. The following are grounds for immediate termination:

• Offensive, abusive, or hateful behavior
• Sexual content or solicitation
• Illegal activity or fraud
• Impersonation or harassment

BacStage retains sole discretion in enforcement decisions.
